The NCBFAA Customs Committee provides helpful information for allowing payment of Single Pay and Post Summary Correction (PSC) entry summaries via ACH Debit Authorization.

Customs and Border Protection (CBP) on Sept. 11 provided the trade with guidance on the modifications to the Section 338 Canada duties pursuant to the Presidential Proclamations on Modifying the Scope of Products of Canada Subject to the Additional Duties Imposed to Offset Canadian Discrimination Against the Commerce of the United States with Respect to Alcoholic Beverages and Motor Vehicles issued on Sept. 8. These changes shall be effective with respect to goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. ET on Sept. 15.

The Food and Drug Administration (FDA) informed cosmetic product facilities, retailers, and industry stakeholders that the agency does not provide certificates or other documents to verify that a company is compliant with FDA's cosmetic product facility registration. Under the 2022 Modernization of Cosmetics Regulation Act (MoCRA), facilities that manufacture or process cosmetic products are required to register their facility with FDA and renew the registration every two years.

The USDA Animal and Plant Health Inspection Service (APHIS) reminds stakeholders that the annual increase in Agricultural Quarantine Inspection (AQI) user fees will be implemented on Oct. 1, as set forth in the May 7, 2024, Federal Register.

Following the CBP 2026 Trade and Cargo Security Summit in Dallas, Dallas, Texas, on Sept. 8-10, NCBFAA advises customs broker members, if they haven’t done so already, to acquaint themselves with the Customs and Border Protection (CBP) Forced Labor Enforcement Operational Guidance for Importers. CBP said this guidance provides a consolidated overview of the three authorities (19 U.S.C. 1307, UFLPA, CAATSA) which the agency uses to prevent the import of goods produced with forced labor into the U.S.

Customs and Border Protection (CBP) on Sept. 10 announced it has deployed the Document Imaging System (DIS) Validation of Internal Transition Number (ITN) for Electronic Export Information (EEI) Submissions (CBP-255) to the ACE Certification environment. The enhancement will be deployed in the ACE Production environment on Oct. 8, the agency said.

With the help from the USDA Agricultural Marketing Service (AMS) and Pork Board, the NCBFAA Regulatory Agencies Committee (RAC) was able to resolve a troublesome check-off assessment issue with the "pork fee." The fee is assessed at the time of entry on imported pork products and varies by HTS number. It is established by the Pork Board with the fees used for pork research, promotion, and consumer outreach.

Customs and Border Protection (CBP) on Sept. 9 announced an update to the ACE Ocean CAMIR Export Manifest – Input to CBP Implementation Guides (IG) for the description in Segment M01, Data Element Vessel Name – to include note “If there is no Vessel name, a vessel ID of “VESSEL” is required.”

President Trump on Sept. 8 announced three proclamations excluding certain Canadian imports related to motor vehicles, dairy products, and alcoholic beverages from entering the U.S. under Section 338 authority. The product import bans will take effect at 12:01 a.m. ET on Sept. 29. In addition, the administration announced two modifications to Section 338 tariffs announced on Canadian goods imports, including motor vehicles and alcoholic beverages, which take effect at 12:01 a.m. ET on Sept. 15.

The Canadian government at 12:01 a.m. ET on Sept. 8 imposed counter-tariffs of up to 50% on myriad U.S. products. Canada’s tariffs were in response to the Aug. 22 U.S. decision to impose 50% Section 338 tariffs on $27.6 billion of Canadian goods. Canada's counter-tariffs will apply to products covering $27.6 billion of U.S. imports and will focus on sectors such as steel, dairy, appliances, agricultural equipment, pulp and paper, and electronics, that are most impacted by U.S. tariffs, the Canadian government said.

Customs and Border Protection (CBP) announced Sept. 4 that it has posted Cargo Release Condition Codes documents on its website which include changes pertaining to Entry Type 13. These changes are expected to be deployed in the ACE Production environment on Sept. 22, the agency said.

The U.S. House of Representatives on Aug. 31 passed legislation to create a trade crimes unit in the Department of Justice (DOJ). The Protecting American Industry and Labor from International Crime (PAIL) Act, H.R. 1869, would establish a dedicated structure within the DOJ criminal division to investigate prosecute trade-related crimes, including duty evasion, forced labor violations, health, safety, and environmental violations and wildlife trafficking, among other illegal activity.

Customs and Border Protection (CBP) announced in the Sept. 3 Federal Register that the next quarterly Commercial Customs Operations Advisory Committee (COAC) meeting will be held virtually on Wednesday, Sept. 23, from 1-5 p.m. ET. NCBFAA members are encouraged to attend the virtual COAC meeting.
